1. Introduction
Welcome to US Publisher House. These Terms & Conditions govern your use of our website and the purchase of our self-publishing, eBook, and related services. By accessing or using our services, you agree to be bound by these Terms.
2. Definitions
- “Client” – any individual or business that engages our publishing services.
- “Services” – includes writing, editing, formatting, design, publishing, marketing, distribution, and related self-publishing offerings.
- “Agreement” – these Terms together with any service proposal or publishing package selected by the Client.
3. Acceptance of Terms
By placing an order, signing a proposal, or using our Services, you confirm that you have read, understood, and agree to these Terms as well as any additional provisions in your publishing agreement.
4. Services
- We will provide the Services described in your signed agreement or chosen package, which may include manuscript evaluation, ghostwriting, editing, eBook formatting, cover design, ISBN registration, distribution setup, and marketing campaigns.
- Timelines for delivery will be communicated in writing; however, they may vary depending on the complexity of the project and Client responsiveness.
- While we info you in publishing, we cannot guarantee book sales, market performance, or commercial success.
5. Client Obligations
- You must provide accurate and complete information, manuscripts, approvals, and timely feedback necessary for us to perform the Services.
- You confirm that your content is original and does not infringe on any third-party intellectual property rights.
- You are responsible for reviewing and approving drafts, designs, or proofs before final publication.
6. Fees and Payment
- Service fees are set forth in your proposal or package agreement.
- Unless otherwise specified, all fees are due in advance before work begins.
- Late payments may incur a 1.5% monthly finance charge. We reserve the right to suspend Services for overdue accounts.
7. Refund Policy
- Setup, creative, and labor fees are non-refundable once work has begun.
- Refunds may be considered on a pro-rata basis only for Services not yet rendered, subject to management approval.
- No refunds will be issued for completed or delivered Services.
8. Intellectual Property
- Clients retain ownership of their manuscripts and creative works.
- US Publisher House retains ownership of proprietary tools, methods, designs, and templates used in the publishing process.
- Upon full payment, Clients receive a non-exclusive, non-transferable license to use the deliverables created for their project.
9. Confidentiality
Both parties agree to treat all non-public information exchanged during the course of Services as confidential and to use it solely for fulfilling the Agreement. This obligation survives termination of the Agreement for two (2) years.
10. Limitation of Liability & Disclaimer
- Our Services and deliverables are provided “as is.” We expressly disclaim warranties of merchantability or fitness for a particular purpose.
- In no event shall our total liability exceed the total fees you have paid to us in the six (6) months preceding any claim.
- We are not liable for indirect, incidental, or consequential damages, including but not limited to lost profits or loss of reputation.
11. Indemnification
You agree to indemnify and hold US Publisher House harmless from any claims, damages, or expenses arising out of (a) your content, (b) your breach of these Terms, or (c) your violation of any applicable law.
12. Term and Termination
- Term: This Agreement begins when Services are initiated and continues until completed or terminated.
- Termination for Convenience: Either party may terminate with 30 days’ written notice.
- Termination for Cause: Immediate termination if either party materially breaches and fails to cure within 10 days of notice.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Kansas (or another jurisdiction as agreed in writing). Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, with each party responsible for its own costs.
14. Changes to Terms
We may update these Terms at any time by posting a revised version on our website. Continued use of our Services after updates constitutes acceptance of the revised Terms.
15. Entire Agreement
These Terms, together with your proposal or publishing package agreement, represent the entire understanding between you and US Publisher House and supersede all prior communications.
